garden tractor pull/contest, and
WHEREAS,
the participant on behalf of
himself/herself, his/her
minor
child or children, his/her heirs and assignees,
desire to use
the facilities and/or equipment and
other property of the
operators of this contest, and
WHEREAS, the participant understands
that there are risks of
injury to person or property in using
said property.
NOW, THEREFORE, that in consideration for the use of the facilities
and
property of the operators and/or
sponsors, in addition to the
fee paid for such use, the
participant agrees as follows:
1.
That
participant voluntarily/knowingly assumes all accident risks
arising out of his/her use of the facilities,
property, and/or
equipment owned/furnished by the
operators and/or sponsors.
2.
That
participant hereby releases and discharges operators
and/or
sponsors from any claim, liability or demand of any
kind due
caused by the negligence of
operators or otherwise.
3.
That participant will indemnify and release operators and/or
sponsors harmless from any claim, liability, or demand of
any
kind from any accident, injury, damage or mechanical
breakage
affecting participant or his equipment.
